The 2014 decrees will include regulations on design and approval of fire prevention and fighting documents as follows:
1. Designing construction planning, investment projects and designing new construction, renovation or changing the nature of use of works and work items (hereinafter collectively referred to as projects and works), Motor vehicles with special requirements for ensuring fire prevention and fighting safety when newly manufactured or converted from all investment capital sources must comply with the provisions of standards and technical regulations on fire prevention and fighting. fire and firefighting. 2. Subjects subject to fire prevention design approval: a) Projects and works specified in Appendix IV issued with this Decree when newly constructed, renovated or changed in nature of use. b) Motor vehicles have special requirements for ensuring fire prevention and fighting safety specified in Clause 2, Article 10 of this Decree when newly manufactured or converted.
3. Documents regulating design and fire prevention and fighting approval Dossier for approving fire prevention and fighting design includes 02 sets, certified by the investor and vehicle owner. : - Written request for review and comments on fire prevention and fighting solutions from the project approval agency or the investor (if authorizing another unit to implement, there must be a written authorization attached). according to);
- Estimated total investment of the planning design project;
- Documents and detailed planning drawings at 1:500 scale show the requirements for fire prevention and fighting solutions specified in Clauses 1, 2, 3 and 4, Article 12 of this Decree.
b) For basic design, documents include: - Written request for review and comments on the investor's fire prevention and fighting solutions (if authorizing another unit to implement, there must be an accompanying authorization document);
- Copy of investment permission document from competent authority; - Estimated total investment of projects and works;
- Drawings and descriptions of the basic design showing the requirements for fire prevention and fighting solutions specified in Clauses 1, 2, 3, 4, 5 and 6, Article 13 of this Decree.
c) For technical design or construction drawing design, documents include:
- Written request for approval of fire prevention and fighting design from the investor (if authorizing another unit to perform, there must be an accompanying authorization document);
- Copy of planning approval document from the competent authority;
- Estimated total investment of projects and works;
- Drawings and descriptions of technical designs or construction drawings showing the requirements for fire prevention and fighting specified in Clauses 1, 2, 3, 4, 5 and 6, Article 13 of Decree this decision.
d) For approval of construction site, documents include: - Written request for approval of the construction location for fire prevention and fighting from the investor (if authorizing another unit to do so, there must be a written authorization, attached);
- A copy of the document clearly stating the legality of the land area where the project is expected to be built;
- Drawings and documents clearly show the current topographical status of the land related to fire prevention and fighting, such as the fire resistance level of the structure, the distance from the proposed construction to surrounding structures, and the direction of the building. wind, construction altitude.
d) For technical designs of motor vehicles with special requirements to ensure fire prevention and fighting safety, documents include:
- Written request for approval of the fire prevention and fighting design of the investor and vehicle owner (if authorizing another unit to perform, there must be an accompanying authorization document);
- Copy of document from competent authority permitting investment, new manufacturing or conversion of vehicles;
- Estimated total vehicle investment; -
Technical design drawings and descriptions showing solutions to ensure fire prevention and fighting safety for the nature of operation and fire and explosion hazard characteristics of the vehicle; conditions for preventing fire, preventing fire spread, escaping, and rescuing people when a fire occurs; solutions to ensure fire prevention and fighting safety for electrical systems, fuel systems and engines; fire alarm systems, fire extinguishers and other fire fighting equipment; systems and equipment to detect and handle leaks of gases and liquids dangerous to fire and explosion.
4. Procedure for approving fire prevention and fighting designs
a) The Fire Prevention and Fighting Police Agency shall appraise and approve fire prevention and fighting designs for technical design documents or construction drawing design documents of projects and works. For the 1:500 scale planning design dossier of the planning design project and the basic design dossier of the project or construction, the Fire Prevention and Fighting Police agency is responsible for responding in writing. report on fire prevention and fighting solutions.

c) Motor vehicles have special requirements to ensure fire prevention and fighting safety, the Fire Prevention and Fighting Police agency shall approve and approve fire prevention and fighting designs for technical design documents. art.
5. Time limit for approving fire prevention and fighting designs The time limit for approving fire prevention and fighting designs is calculated from the date of receipt of all valid documents, specifically as follows:
a) Planning design project: No more than 10 working days.
b) Approval of construction site: No more than 05 working days.
c) Basic design: No more than 10 working days for group A projects; no more than 05 working days for group B and C projects. d) Technical design or construction drawing design: No more than 15 working days for group A projects and works; no more than 10 working days for group B and C projects and works. Grouping of projects and works into groups A, B, C above is carried out according to the Government's regulations on construction investment project management. d) Technical design of motor vehicles with special requirements to ensure fire prevention and fighting safety: No more than 10 working days.
6. Projects and works not on the list specified in Appendix IV issued with this Decree, when newly constructed, renovated or changed in nature of use, must still be designed to ensure fire prevention and safety requirements. fire fighting according to the provisions of standards and technical regulations on fire prevention and fighting, but it is not required to approve fire prevention and fighting designs.
7. The content of fire prevention and fighting design approval for planning design projects must comply with the provisions in Clauses 1, 2, 3 and 4, Article 12 of this Decree; Construction design must comply with the provisions in Clauses 1, 2, 3, 4, 5 and 6, Article 13 of this Decree. The results of fire prevention and fighting design approval are one of the bases for reviewing and approving projects and issuing construction permits.
8. The Ministry of Public Security regulates the decentralization of fire prevention and fighting design approval for projects, works, and motor vehicles with special requirements to ensure fire prevention and fighting safety. ; Provide guidance on the content and procedures for approving fire prevention and fighting designs.
9. The Ministry of Finance shall preside over and agree with the Ministry of Public Security to regulate the collection and use of design approval fees for fire prevention and fighting. Fees for design approval for fire prevention and fighting are determined in the total investment of the project, construction and motor vehicle.
