1. Fire prevention and fighting service business establishments (hereinafter referred to as business establishments) include: Enterprises; cooperatives, unions of cooperatives; branches and establishments affiliated to enterprises, cooperatives and unions of cooperatives; non-business units of agencies and organizations; household business.

2. The head, the legal representative of the business establishment specified in Clause 1 of this Article must have a diploma or certificate of training in knowledge of fire prevention and fighting and be the person named in one of the the following documents: Certificate of business registration; Investment registration certificate; Certificate of operation registration of the branch or affiliated unit of the enterprise; Certificate of registration of cooperatives and unions of cooperatives; Certificate of registration of branches and business locations of cooperatives and unions of cooperatives; Operation license issued by competent state management agencies; Certificate of business household registration; the document of establishment or permit of operation enclosed with the written notice of the rental code for the non-business unit. In case the head, the legal representative of the business establishment is a foreigner who has obtained a diploma or certificate of training in knowledge of fire prevention and fighting or a practicing certificate in fire prevention and fighting. issued by a foreign agency or organization, a consular legalization document is required.
3. Having physical facilities, means and equipment to ensure fire prevention and fighting service business:
a) For a business establishment providing design consultancy, appraisal consultancy, and supervision consultancy on fire prevention and fighting: Having an operating location; means and equipment to ensure the implementation of design consultancy, appraisal consultancy, and supervision consultancy on fire prevention and fighting;
b) For business establishments providing technical inspection and testing consultancy on fire prevention and fighting: Having laboratories and testing equipment recognized by competent authorities for quality;
c) For business establishments providing fire prevention and fighting technology transfer consultancy; training and guidance on fire prevention and fighting operations: Having means and equipment to ensure technology transfer consultancy; means and equipment for training, locations for training and instructions on fire prevention and fighting operations;
d) For establishments doing business in construction and installation of fire prevention and fighting systems: Having means, equipment and machinery to ensure the construction and installation of fire prevention and fighting systems;
dd) For a business establishment engaged in the production and assembly of fire prevention and fighting means and equipment: Having an operating location; have workshops, vehicles and equipment for production, assembly and testing of fire prevention and fighting equipment and vehicles.
4. For a business establishment providing design consultancy, appraisal consultancy and supervision consultancy on fire prevention and fighting, in addition to the provisions of Clauses 2 and 3 of this Article, there must be at least 02 qualified individuals. The practicing certificate of fire prevention and fighting consultancy is suitable for the consulting field as prescribed at Points b, d, Clause 3, Article 43 of this Decree; in which at least 01 individual holds the title of chief of design, appraisal and supervision of fire prevention and fighting.
5. For a business establishment providing technical inspection and testing consultancy on fire prevention and fighting, apart from the provisions of Clauses 2 and 3 of this Article, there must be at least 02 individuals possessing practicing certificates according to regulations. specified at Point c, Clause 3, Article 43 of this Decree.
6. For business establishments providing consultancy on fire prevention and fighting technology transfer; For training and guidance on fire prevention and fighting operations, in addition to the provisions of Clauses 2 and 3 of this Article, at least 01 person must have a university or higher degree in fire prevention and fighting or a university degree. or higher in another industry relevant to the field of operation and be granted a certificate of training in knowledge of fire prevention and fighting.
7. For a business establishment engaged in the construction and installation of fire prevention and fighting systems, apart from the provisions of Clauses 2 and 3 of this Article, there must be at least 01 construction chief commander who has been granted a practicing certificate. direct the construction of fire prevention and fighting according to the provisions of Point dd, Clause 3, Article 43 of this Decree.
8. For a business establishment engaged in the production and assembly of fire prevention and fighting means and equipment, in addition to the provisions of Clauses 2 and 3 of this Article, there must be at least 01 person with a university degree or higher. major in fire prevention and fighting or a university degree or higher in another discipline relevant to the field of operation and a certificate of training in knowledge of fire prevention and fighting shall be granted.

9. For establishments trading in fire prevention and fighting means, equipment and supplies, they must satisfy the provisions of Clauses 2 and 3 of this Article.
