1. Subjects must be trained and professionally trained in fire prevention and fighting

a) Person with the title of fire fighting commander specified in Clause 2, Article 37 of the Law on Fire Prevention and Fighting;

b) Members of civil defense team, grassroots fire prevention and fighting team; c) Member of specialized fire prevention and fighting team;

d) Persons working in environments with danger of fire and explosion or frequently in contact with goods at risk of fire and explosion;

d) Vehicle drivers, people working on motor vehicles transporting passengers with more than 29 seats and motor vehicles transporting goods at risk of fire or explosion;

e) Persons in charge of fire prevention and fighting at establishments on the list specified in Appendix IV issued with this Decree;

g) Members of forest fire prevention and fighting teams and units.

2. Content of training and professional development on fire prevention and fighting

a) Legal knowledge, knowledge of fire prevention and fighting appropriate to each subject;

b) Propaganda methods and building a movement for all people to participate in fire prevention and fighting;

c) Fire prevention measures; fire fighting measures, tactics and techniques;

d) Methods of developing and practicing fire fighting plans; dd) Methods of preservation and use of fire prevention and fighting means;

e) Methods of checking fire prevention and fighting safety.

3. Time of training and retraining of fire prevention and fighting skills

a) Time for first-time professional training and retraining: From 16 to 24 hours for the subjects specified at Points a, b, d, dd, e and g, Clause 1 of this Article and from 32 to 48 hours for the subjects specified at Point c, Clause 1 of this Article;

b) The time for retraining to be granted a certificate of training in fire prevention and fighting operations after the expiry of this certificate is at least 16 hours for the subjects specified at points a, b, d, dd, e and point g Clause 1 of this Article and 32 hours for the subjects specified at Point c, Clause 1 of this Article; c) Annual additional training in fire prevention and fighting operations is at least 08 hours for subjects specified in Points a, b, d, dd, e and g, Clause 1 of this Article and at least 16 hours. hours for the subjects specified at Point c, Clause 1 of this Article.

4. Responsibilities for organizing fire prevention and fighting training and retraining:

a) Presidents of People's Committees at all levels, heads of agencies, organizations and establishments shall have to organize training in fire prevention and fighting skills for subjects under their management;

b) Agencies, organizations, establishments or individuals that wish to receive training and retraining in fire prevention and fighting skills shall request the police agency or establishments to provide training and guidance on fire prevention and fighting skills. The fire department has been certified to be eligible for fire prevention and fighting service business and organizes training. Funds for organizing training shall be borne by agencies, organizations, establishments or individuals participating in training.

5. Dossier of application for the Certificate of professional training in fire prevention and fighting:

a) For training establishments providing training on fire prevention and fighting operations: Written request for inspection and issuance of training certificate (Form No. PC21); training plans, programs and contents; a short list of resumes of people who have been trained;

b) For agencies, organizations, and establishments that request the Police agency or a training facility providing guidance on fire prevention and fighting operations to organize training: Written request for training, inspection, and issuance training certificate (Form No. PC22); a short list of resumes of trainees who register for training;

c) For individuals who need to be trained and issued a Certificate of professional training in fire prevention and fighting: Written request for training, inspection, and issuance of training certificate (Form No. PC23).

6. Documents requesting replacement of Certificate of professional training in fire prevention and fighting in case of damage include written request for replacement or re-issuance of Training Certificate (Form No. PC24) and Certificate of professional training. previously issued fire prevention and fighting services.

7. Dossier to request re-issuance of the Fire Prevention and Fighting Professional Training Certificate in case of loss: Written request for re-issuance of the Training Certificate (Form No. PC24).

8. Agencies, organizations and individuals submit 01 set of documents to the competent authority specified in Clause 13 of this Article in one of the following forms:

a) Directly at the Single Window Department of the competent authority;

b) Online at the public service portal of the competent authority (for documents and papers on the list of state secrets, comply with the law on protection of state secrets);

c) Through public postal services, through hiring services from businesses, individuals or through authorization according to the provisions of law.

9. The officer receiving the dossier is responsible for checking the composition and validity of the dossier and complying with the following regulations:

a) In case the dossier is complete and valid according to regulations, receive and record information in the Receipt Form for handling administrative procedures on fire prevention and fighting (Form No. PC03);

b) In case the dossier is incomplete or not valid according to regulations, instructions are given to complete the dossier according to regulations and record information in the Instruction Sheet for supplementing dossiers to request administrative procedures to be resolved to the department. fire and fighting (Form No. PC04).

10. Notification of results of processing of dossiers:

a) In case the application is submitted directly at the One-Stop Department of a competent agency, the officer receiving the dossier must directly hand over 01 copy of the receipt for handling administrative procedures on fire prevention and fighting or the provide guidance on supplementing dossiers of request for settlement of administrative procedures on fire prevention and fighting for those who submit dossiers and keep 01 copy;

b) In case of submitting the application through the Public Service portal of the competent authority, the receiving officer will send a notification via email or phone message about the receipt or instructions for supplementing the application to the agency or organization. Organizations and individuals have submitted

- In case the number of people registering for training is 20 or more: Within 05 working days from the date of receiving complete and valid documents, the Police agency is responsible for organizing training, inspection, and assessment. evaluate the results of the subjects participating in the training;

- In case the number of people registering for training is less than 20 people: The police agency is responsible for gathering; when the number is sufficient, notify the time and location of the training and examination and evaluation of the results;

c) Within 05 working days from the date of having satisfactory inspection results, the competent police agency shall issue the certificate of training in fire prevention and fighting (Form No. 02 issued together with Decree No. 83/2017/ND-CP dated July 18, 2017 of the Government regulating the rescue and rescue work of the fire prevention and fighting forces) for individuals who complete professional training programs. In case of refusal to issue a Certificate, a written reply must be given, clearly stating the reason;

d) The time limit for the renewal or re-issuance of the Certificate of training in fire prevention and fighting is 05 working days from the date of receipt of a complete and valid dossier. In case of refusal to grant, change or re-issue the Certificate, there must be a written reply, clearly stating the reason.

 

13. Certificate of professional training in fire prevention and fighting by the Department of Fire Prevention, Fighting and Rescue, Rescue Police Department, Fire Prevention, Fighting and Rescue Police Department, Provincial Police, Public Security Issued at district level and valid for use nationwide for a period of 5 years from the date of issue. At the end of this period, training must be re-trained to obtain a new Certificate.
