Chapter I

GENERAL RULES Article 1. Scope This Decree regulates fire prevention and fighting activities, organization of fire prevention and fighting forces and means, business of fire prevention and fighting services, funding to ensure fire prevention and fighting activities, Responsibilities of ministries, ministerial-level agencies, Government agencies, and People's Committees at all levels in fire prevention and fighting activities.

Article 2. Subjects of application This Decree applies to agencies, organizations, households and individuals operating and living in the territory of the Socialist Republic of Vietnam.

Article 3. Appendix Issued together with this Decree are the following appendices: 1. Appendix I: List of establishments under fire prevention and fighting management.

2. Appendix II: List of establishments at risk of fire and explosion.

3. Appendix III: List of establishments managed by the Police.

4. Appendix IV: List of establishments managed by commune-level People's Committees.

5. Appendix V: List of projects, works, and motor vehicles subject to design approval for fire prevention and fighting.

6. Appendix VI: List of fire prevention and fighting equipment.

7. Appendix VII: List of fire prevention and fighting equipment subject to inspection.

8. Appendix VIII: Specifications of flags, signs and tape used in firefighting.

9. Appendix IX: Forms used in fire prevention and fighting.

chapter II FIRE PROTECTION Article 4. Facilities under fire prevention and fighting management 1. Basis specified in Clause 3, Article 3 of the 2001 Law on Fire Prevention and Fighting, amended and supplemented according to the provisions of Clause 1, Article 1 of the Law amending and supplementing a number of articles of the Law on Fire Prevention and Fighting 2013 (hereinafter referred to as the Law on Fire Prevention and Fighting) is determined to be an establishment under fire prevention and fighting management. Agencies and organizations may have one or more facilities; Within one facility, there may be many agencies and organizations operating together. 2. The list of establishments subject to fire prevention and fighting management is specified in Appendix I issued with this Decree. Article 5. Safety conditions for fire prevention and fighting for establishments 1. Establishments on the list specified in Appendix III issued with this Decree must ensure the following fire prevention and fighting safety conditions: a) There are rules, prohibition signs, signs, diagrams or instruction signs on fire prevention and fighting and escape in accordance with regulations and standards on fire prevention and fighting or according to regulations of the Ministry of Public Security; b) Have a local and specialized fire prevention and fighting force corresponding to the type of facility, trained in fire prevention and fighting skills and organized fire fighting readiness to meet on-site fire fighting requirements according to regulations. regulations, except for the cases specified in Point g, Clause 3, Article 31 of this Decree; c) Have a fire fighting plan approved by a competent authority; d) Electrical systems, lightning protection, anti-static, equipment that uses electricity, generates fire, generates heat, and the use of fire sources and heat sources must ensure fire prevention and fighting safety in accordance with regulations, fire prevention and fighting standards or according to regulations of the Ministry of Public Security;

2. Establishments on the list specified in

Appendix IV issued with this Decree must ensure the following fire prevention and fighting safety conditions:

a) Conditions specified in Points a, c and d, Clause 1 of this Article; In case the facility belongs to the list specified in Appendix V of this Decree, it must have a Certificate of design approval and design approval document (if any) and a written acceptance of the acceptance results of fire prevention and fighting. on fire; b) Have traffic, water supply, communication systems for fire fighting, fire alarm, fire fighting, fire prevention, smoke prevention, escape systems, other fire prevention and fighting means, and life saving means ensure quantity and quality in accordance with standards and technical regulations on fire prevention and fighting or according to regulations of the Ministry of Public Security;

c) There are regulations and assignment of responsibilities and tasks for fire prevention and fighting. Persons in charge of fire prevention and fighting must be trained and fostered in fire prevention and fighting skills according to the provisions of Article 33 of this Decree.

3. Agencies and organizations operating within a facility that has ensured fire prevention and fighting safety conditions specified in Clauses 1 and 2 of this Article, within the scope of their management, must implement the following regulations: the following content:

a) Ensuring the conditions specified in Point a, Clause 1 of this Article;

b) Using electrical equipment that produces fire or heat, fire sources and heat sources must ensure fire prevention and fighting safety;

c) Appoint people to join the grassroots fire prevention and fighting team;

d) Coordinate with the head of the facility to implement and maintain fire safety conditions within their scope of management.

4. Fire prevention and fighting safety conditions specified in Clauses 1, 2 and 3 of this Article must be implemented by the heads of agencies, organizations and establishments before being put into operation and approved. maintained throughout operation. In case there are many agencies and organizations operating together in a facility, the head of the facility is responsible for managing and maintaining the general fire prevention and fighting safety conditions of the facility.

5. Records of management and monitoring of fire prevention and fighting activities of establishments in the list specified in Appendix III and Appendix IV issued with this Decree are prepared and kept by the head of the establishment. Document components comply with regulations of the Ministry of Public Security.

Article 6. Safety conditions for fire prevention and fighting for residential areas 1. Residential area is the living place of individuals and households arranged within the scope of villages, hamlets, hamlets, villages, hamlets, hamlets, residential groups and equivalent residential units (collectively referred to as village). A village is defined as a residential area under fire prevention and fighting management. 2. 3. Fire prevention and fighting safety conditions specified in Clause 2 of this Article must be organized and maintained by the Chairman of the Commune People's Committee throughout the operation. Article 7. Safety conditions for fire prevention and fighting for households 1. Households must ensure safety conditions for fire prevention and fighting as prescribed in Clause 1, Article 17 of the Law on Fire Prevention and Fighting. 2. Households living in combination with production and business must ensure the following fire prevention and fighting safety conditions: a) Conditions as prescribed in Clause 1 of this Article; b) Have regulations on fire prevention and fighting, use of electricity, use of fire and flammable and explosive substances in accordance with technical regulations and standards on fire prevention and fighting or according to regulations of the Ministry of Industry and Trade. security; c) Have solutions to escape, prevent fire spread, and prevent smoke between living areas and production and business areas.

3. Fire prevention and fighting safety conditions specified in Clauses 1 and 2 of this Article must be implemented and maintained by the household owner throughout the operation.

4. Households specified in Clause 2 of this Article that have been granted a Business Registration Certificate must ensure fire safety conditions corresponding to the type of establishment as prescribed in Article 5 of the Decree. This. Article 8. Safety conditions for fire prevention and fighting for motor vehicles

1. Road motor vehicles with 04 seats or more must ensure inspected operating conditions; Supplies and goods placed and arranged on vehicles must ensure fire prevention and fighting safety. For road motor vehicles with more than 09 seats, vehicles operating on inland waterways, and railway vehicles must ensure the following conditions:

a) Have regulations, prohibition signs, signs, and instruction signs in accordance with regulations and standards on fire prevention and fighting or according to regulations of the Ministry of Public Security;

b) The electrical system, fuel, supplies, and goods arranged and arranged on the vehicle must ensure fire prevention and fighting safety;

c) Have fire-fighting equipment suitable to the nature and characteristics of operations, ensuring quantity and quality in accordance with regulations and standards on fire prevention and fighting or according to regulations of the Ministry of Public Security;
